Welcome to Nook Box.
These Terms of Service apply when you access or use the Nook Box website, create an account, place an order, purchase a subscription or otherwise purchase products or services from Nook Box.
By using our website or placing an order, you agree to these Terms of Service and any other policies applicable to your purchase, including our Returns & Refunds Policy, Shipping Policy and Subscription Policy.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable Australian law.

Nook Box is an Australian online retailer specialising in curated romance books, book subscriptions, special editions and bookish products.
Our products and services may be available to customers in Australia and selected international destinations.

You agree to use the Nook Box website only for lawful purposes.
You must not knowingly:
- Use the website for fraudulent or unlawful activity;
- Interfere with the operation or security of the website;
- Attempt to gain unauthorised access to our systems or customer accounts;
- Use automated systems to improperly purchase limited-stock products;
- Scrape, reproduce or commercially exploit website content without permission; or
- Use the website in a way that infringes the rights of Nook Box or another person.
We may restrict or suspend access to our website where reasonably necessary to protect Nook Box, our customers or our systems.
3. Eligibility to Purchase
You must be legally capable of entering into a purchase agreement to place an order with Nook Box.
Products containing mature or adult content may be restricted to customers aged 18 years or over.
Nook Box subscriptions are intended for customers aged 18 years and over.
By purchasing an age-restricted product or subscription, you confirm that you meet the applicable age requirement.
4. Product Information
We do our best to ensure product descriptions, photographs, pricing and other information on our website are accurate.
However, books and bookish products are physical products and reasonable variations can occur between batches and individual items.
Depending on the product, variations may include:
- Colour or finish;
- Foil placement;
- Sprayed, stencilled or printed edges;
- Print alignment;
- Trimming;
- Artwork positioning;
- Fabric or material appearance;
- Handmade characteristics;
- Signatures or bookplates; and
- Other minor manufacturing characteristics.
Reasonable manufacturing variations are not necessarily faults.
Nothing in this section limits your rights where a product fails to meet a consumer guarantee under the Australian Consumer Law.
5. Product Images & Mock-Ups
Product photography is intended to represent products as accurately as reasonably possible.
However, colours may appear differently depending on your screen, device and display settings.
For products that have not yet completed production, including special editions and custom products, we may use digital mock-ups, samples, prototypes or supplier images.
These images are intended to represent the expected final product, but reasonable differences may occur during manufacturing.
Where a material change is made to an advertised product before fulfilment, we will communicate this where reasonably appropriate.
6. Books & Third-Party Content
Nook Box curates books from authors and publishers and may feature products or artwork created in collaboration with third parties.
Opinions, themes, characters, stories and views contained within books are those of their respective authors and creators and do not necessarily represent the views of Nook Box.
Where reasonably available, we may provide information about mature themes, content or potential triggers. This information is provided as a guide and may not identify every potentially sensitive topic within a book.
7. Mystery & Spoiler Products
Some Nook Box products may intentionally be sold without revealing all or part of their contents.
By purchasing a product clearly identified as a mystery, surprise, spoiler-free or similar product, you acknowledge that the exact contents may not be known to you before purchase.
Receiving an item, design, book or theme that is not personally to your taste does not, by itself, make the product faulty or entitle you to a change-of-mind refund.
Your rights in relation to faulty, damaged or incorrectly supplied products remain unaffected.
8. Placing an Order
Submitting an order through our website is an offer to purchase the selected products.
An order is not necessarily accepted merely because payment has been authorised or an automated order confirmation has been generated.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- A product is unexpectedly unavailable;
- There is an obvious pricing or listing error;
- Incorrect stock information has been displayed;
- Payment cannot be verified;
- Fraudulent or unauthorised activity is reasonably suspected;
- Purchase quantity restrictions have been exceeded;
- We reasonably believe products are being purchased for unauthorised commercial resale;
- A promotion has been misused; or
- We are otherwise unable to lawfully fulfil the order.
If we cancel an order after receiving payment and do not supply the relevant products, we will provide an appropriate refund.
9. Limited Stock
Many Nook Box products are produced or purchased in limited quantities.
Adding an item to your cart does not reserve that item.
Products may sell out while they are in your cart or during checkout.
Once stock is exhausted, we are not required to reproduce or restock a limited product.
10. Quantity Limits & Commercial Resale
Nook Box products are primarily intended for personal use.
We may impose purchase limits on limited editions, subscription boxes, promotional products or other products.
You must not deliberately circumvent purchase limits by using multiple accounts, email addresses, payment methods or orders.
We may cancel orders where we reasonably believe products are being purchased in excessive quantities primarily for unauthorised commercial resale or profiteering.
Please contact us before placing a commercial or bulk order.
11. Pricing & Currency
Prices may be displayed in your local currency depending on your location and the functionality available through our online store.
Australian prices include GST where applicable.
International customers may see converted or localised pricing through Shopify or our payment providers.
Currency conversion rates may change and your payment provider may apply its own conversion fees or charges.
International prices do not necessarily include customs duties, import taxes, VAT, handling charges or other destination-country charges unless expressly stated at checkout.

12. Pricing Errors
We make reasonable efforts to ensure our prices are correct.
Occasionally, a product may be listed at an incorrect price due to a technical, administrative or other error.
Where an obvious pricing error occurs, we may correct the error and, where reasonably necessary, cancel the affected order.
If an affected order is cancelled after payment has been received, the amount paid for the cancelled products will be refunded.
13. Payments
Payment must be made using one of the payment methods available at checkout.
Available payment methods may vary depending on your location, products and order type.
You agree to provide current, complete and accurate payment and billing information.
By submitting payment information, you confirm that you are authorised to use the selected payment method.
14. Afterpay & Other Third-Party Payment Services
Nook Box may offer payment services provided by third parties, including Afterpay, on eligible purchases.
Availability of a particular payment method depends on factors including the products purchased, order type, customer eligibility and the payment provider's applicable terms.
Afterpay is not currently available for Nook Box subscription payments where this is not permitted by Afterpay's applicable terms or our subscription platform.
Where you choose a third-party payment provider, your use of that service is also subject to the provider's applicable terms, eligibility requirements and privacy practices.
A dispute between you and a payment provider does not remove any rights you may have against Nook Box under Australian Consumer Law.
15. Gift Cards
Nook Box may offer gift cards from time to time.
Gift cards will be subject to any conditions displayed when purchased and applicable Australian gift card laws.
Gift cards are not redeemable for cash except where required by law.
Eligibility to use gift cards for recurring subscription payments may depend on the functionality of our subscription and payment platforms.
16. Pre-Orders & Special Editions
Nook Box may offer pre-orders, special editions, exclusive editions, limited releases and made-to-order products.
These products may require us to commit funds to authors, publishers, artists, printers, manufacturers and other suppliers shortly after orders are placed.
Unless otherwise stated or required by law, pre-orders, special editions and made-to-order products are final and cannot be cancelled or refunded due to change of mind once the order has been placed.
Estimated production, release and dispatch dates are provided in good faith based on the information available to us.
Delays can occur due to printing, publishing, manufacturing, freight, customs or other circumstances.
Where a delay or other issue gives rise to rights or remedies under Australian Consumer Law, those rights will continue to apply.
17. Special Edition Variations
Special-edition books and products may involve processes such as foiling, sprayed or stencilled edges, custom printing, binding, signatures, bookplates, overlays or other hand-finished or small-batch production methods.
Minor differences between copies can occur.
Reasonable variations in placement, colour, finish, alignment or other cosmetic characteristics are not necessarily defects.
Our Returns & Refunds Policy provides further information about damaged or faulty products.
18. Subscriptions
Recurring Nook Box subscriptions are subject to our separate Subscription Policy.
That policy explains recurring payments, renewal dates, skipping, cancellations, failed payments, subscription changes and other subscription-specific conditions.
By purchasing a recurring subscription, you also agree to the Subscription Policy applicable at the time of purchase.
19. Shipping & Delivery
Orders are shipped in accordance with our Shipping Policy.
Shipping timeframes are estimates unless expressly stated otherwise.
International customers may be responsible for applicable duties, taxes, customs charges or other import costs.
20. Returns, Refunds & Faulty Products
Returns, refunds, replacements and damaged or faulty products are handled in accordance with our Returns & Refunds Policy and Australian Consumer Law.
Nothing in these Terms is intended to exclude or restrict a consumer guarantee that cannot lawfully be excluded.
21. Discount Codes & Promotions
Nook Box may offer discount codes, promotional pricing, subscriber offers and other promotions from time to time.
Each promotion may be subject to additional conditions, including:
- Eligibility requirements;
- Minimum purchase amounts;
- Eligible or excluded products;
- Start and end dates;
- Usage limits;
- Customer limits; and
- Whether the promotion can be combined with another offer.
Some discounts may be combined where our website expressly allows this. Other promotions may not be combined.
Unless otherwise stated, discount codes and promotional prices:
- Must be applied before completing checkout;
- Cannot be applied retrospectively to completed orders;
- Cannot be exchanged for cash; and
- Cannot be used outside their stated eligibility period.
We may cancel or refuse a promotion where we reasonably believe it has been obtained or used fraudulently or in deliberate circumvention of its stated conditions.
22. Free Gifts & Promotional Items
From time to time, eligible purchases may include a free promotional gift.
Free gifts are available only while the advertised stock lasts. Once the applicable gift is exhausted, no substitute gift will be provided, unless otherwise expressly stated.
A free gift has no cash alternative unless required by law.
If an order is cancelled or returned and the cancellation or return means the original purchase no longer qualifies for the promotional gift, the gift must also be returned in its original condition where reasonably practicable.
If the applicable gift is not returned, we may take its advertised or reasonable value into account when processing a voluntary change-of-mind refund, to the extent permitted by law.
This does not limit your rights in relation to faulty goods under Australian Consumer Law.
23. Competitions & Giveaways
Nook Box may run competitions, giveaways or similar promotions.
Individual competitions may have their own eligibility requirements, dates, prize conditions and specific terms.
Where specific competition terms are provided, those terms apply to that promotion and take precedence over these general Terms to the extent of any inconsistency.
24. Customer Reviews, Photos & Social Content
We love seeing your Nook Box unboxings, book mail, reviews and bookish content.
If you tag or mention Nook Box, use a Nook Box campaign hashtag, submit a review, respond to a Nook Box content request, send content directly to us or otherwise intentionally share content with Nook Box, you grant Nook Box permission to repost, reproduce and use that content for Nook Box marketing and promotional purposes.
This may include use on:
- Nook Box social media accounts;
- The Nook Box website and online store;
- Nook Box email marketing;
- Organic social media and digital marketing; and
- Other Nook Box-owned marketing channels.
This permission is non-exclusive and royalty-free. You retain ownership of your original content and granting Nook Box permission to use it does not transfer ownership to us.
By intentionally tagging, mentioning or submitting content to Nook Box, you confirm that:
- You created the content or otherwise have the rights necessary to share it;
- You have permission from any other identifiable people appearing in the content where reasonably required; and
- Our permitted use of the content will not knowingly infringe another person's intellectual property, privacy or other rights.
Where reasonably practicable, Nook Box may credit or tag the original creator when reposting social media content, but we cannot guarantee that attribution will be included in every use.
We may make reasonable modifications to content for formatting or presentation purposes, including cropping, resizing, adding text or Nook Box branding, adjusting the format or adapting the content for different platforms. We will not intentionally edit content in a way that materially misrepresents you or your views.
If you would like Nook Box to stop using content you have previously shared with us, please contact hello@nookbox.com.au. We will take reasonable steps to stop future use of that content on channels controlled by Nook Box. This may not require us to recall, withdraw or reproduce marketing materials that have already been published, distributed, printed or produced.
Permission granted under this section does not automatically extend to using your content or likeness as a paid advertisement or paid endorsement. Where we wish to use identifiable customer content as the creative for a paid advertising campaign, we may seek additional permission where appropriate.
Nook Box is not required to use or repost customer content and may remove or discontinue use of content at any time.
25. Intellectual Property
Unless otherwise stated, Nook Box owns or is authorised to use the branding, original product designs, graphics, photography, website design, written content and other original materials appearing on our website and marketing channels.
You may view and use this content for personal, non-commercial purposes.
You must not reproduce, copy, modify, manufacture, distribute, sell or commercially exploit Nook Box intellectual property without prior permission.
26. Third-Party Intellectual Property
Books, book covers, titles, characters, author names, publisher marks, licensed artwork, trademarks and other third-party intellectual property remain the property of their respective owners or rights holders.
The inclusion or sale of a third-party product through Nook Box does not transfer ownership of that intellectual property to Nook Box or the customer.
27. External Links & Third-Party Services
Our website may contain links to or integrations with third-party websites and services.
These services may have their own terms, privacy policies and operating practices.
Nook Box is not responsible for the content or operation of an independent third-party website or service, except to the extent responsibility cannot lawfully be excluded.
28. Website Availability
We aim to keep our website available and functioning correctly, but uninterrupted access cannot be guaranteed.
We may temporarily restrict access for maintenance, updates, security or technical reasons.
We are not responsible for temporary website interruptions outside our reasonable control, subject to any rights that cannot lawfully be excluded.
29. Errors & Corrections
We may correct typographical errors, inaccurate descriptions, pricing errors, stock information or other website mistakes when identified.
Where an error materially affects an order you have already placed, we will take reasonable steps to contact you and provide an appropriate resolution.
30. Fraud & Misuse
We may investigate, cancel or restrict orders or accounts where we reasonably suspect fraud, unauthorised payment activity, deliberate promotional abuse, commercial exploitation of limited-stock products or other unlawful activity.
This does not affect a customer's legitimate right to make a complaint, request a remedy or exercise their rights under applicable law.
31. Limitation of Liability
To the maximum extent permitted by law, Nook Box is not liable for losses that are indirect, consequential or not reasonably foreseeable as a result of your use of our website or products.
Nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under Australian Consumer Law or other applicable law.
32. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes to our products, website, business practices or legal requirements.
The current version will be published on our website with the date it was last updated.
Changes will generally apply from the date the updated Terms are published.
Where a change materially affects an existing recurring subscription, we will provide reasonable advance notice where required or appropriate.
33. Governing Law
These Terms are governed by the laws of Australia and, where applicable, the State of Victoria.
Nothing in this section limits any rights you may have under mandatory consumer protection laws that apply to you.
